These terms govern your use of enduroapparel.com.au and any purchase you make from us. Please read them together with our Privacy Policy and Shipping & Returns policy, which form part of these terms. By using the site or placing an order, you agree to them.
01About us
The site is operated by BCHF Ventures Pty Limited (ABN 41 699 761 067), trading as Enduro Apparel, based in Paddington, Sydney NSW, Australia. In these terms, "enduro", "we", "us" and "our" refer to Enduro Apparel, and "you" refers to the person using the site or placing an order. You can reach us at info@enduroapparel.com.au.
02Eligibility
To place an order you must be at least 18 years of age, or have the consent of a parent or guardian, and be able to form a legally binding contract. By ordering you confirm that the information you provide is accurate and complete.
03Products
We take care to describe and display our products accurately. Because our garments are made from natural fibres, slight variation in colour, texture and finish between pieces is normal and is part of the material — it is not a fault. Screen settings can also affect how colours appear. Product availability is not guaranteed and may change without notice.
04Pricing
All prices are shown in Australian dollars (AUD) and are inclusive of GST. Prices exclude shipping unless stated otherwise; shipping is calculated at checkout. We may change prices at any time, but changes will not affect orders we have already accepted. While we work to ensure prices are accurate, if a product is listed at an incorrect price due to an obvious error, we may cancel the order and refund you in full.
05Orders and acceptance
When you place an order, you are making an offer to purchase. We will send an order acknowledgement by email, but a binding contract is only formed once we accept your order — usually when we dispatch the goods (or, for pre-orders, when we confirm the pre-order). We may decline or cancel an order, including where an item is out of stock, where there has been a pricing or product error, or where we suspect fraud or a breach of these terms. If we cancel an order you have paid for, we will refund you in full.
06Pre-orders
Some items are offered on a pre-order basis. For pre-orders:
- Payment is taken at the time you place the order, which reserves your item.
- The estimated dispatch window shown at checkout is an estimate only and may change. We will keep you updated if timing shifts materially.
- You may cancel a pre-order for a full refund at any time before it is dispatched by contacting us at info@enduroapparel.com.au.
- Where an order contains both pre-order and in-stock items, please see our Shipping & Returns policy for how it will be dispatched.
07Payment
We accept major credit and debit cards (Visa, Mastercard, American Express) and any additional payment options shown at checkout. Payments are processed securely by our third-party payment provider; we do not store your full card details. You confirm that you are authorised to use the payment method you provide.
08Shipping and delivery
Delivery timeframes, costs and coverage are set out in our Shipping & Returns policy. Delivery estimates are indicative and not guaranteed. Risk in the goods passes to you on delivery to the address you provide.
09Returns, exchanges and your consumer rights
Our change-of-mind returns and exchange process is set out in our Shipping & Returns policy. Nothing in these terms limits your rights under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
10Intellectual property
All content on this site — including the enduro name and logo, the Ø device, product designs, photography, graphics, text and layout — is owned by or licensed to enduro and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any of it for commercial purposes without our prior written permission.
11Your use of the site
You agree to use the site only for lawful purposes. You must not interfere with or disrupt the site, attempt to gain unauthorised access, introduce malicious code, or scrape or harvest content or data. We may suspend or restrict access if we reasonably believe these terms have been breached.
12Third-party links
The site may contain links to third-party websites or services. We provide these for convenience and are not responsible for their content, products or privacy practices. Accessing them is at your own risk.
13Limitation of liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to those rights, and to the extent permitted by law, we are not liable for any indirect, incidental or consequential loss, and our liability for a failure to comply with a consumer guarantee (where it can be limited) is limited, at our option, to replacing the goods or supplying equivalent goods, or paying the cost of doing so.
14Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
15Changes and severability
We may update these terms from time to time. The version published on this page at the time you place an order applies to that order. If any part of these terms is found to be invalid or unenforceable, the remaining parts continue to apply.
