01About us

The site is operated by BCHF Ventures Pty Limited (ABN 41 699 761 067), trading as Enduro Apparel, based in Paddington, Sydney NSW, Australia. In these terms, "enduro", "we", "us" and "our" refer to Enduro Apparel, and "you" refers to the person using the site or placing an order. You can reach us at info@enduroapparel.com.au.

02Eligibility

To place an order you must be at least 18 years of age, or have the consent of a parent or guardian, and be able to form a legally binding contract. By ordering you confirm that the information you provide is accurate and complete.

03Products

We take care to describe and display our products accurately. Because our garments are made from natural fibres, slight variation in colour, texture and finish between pieces is normal and is part of the material. It is not a fault. Screen settings can also affect how colours appear. Product availability is not guaranteed and may change without notice.

04Pricing

Prices for Australian customers are shown in Australian dollars (AUD) and include GST. If you shop from the United States, the United Kingdom, the European Union or New Zealand, prices are shown in your local currency and you are charged in that currency at checkout. Duties and import taxes, where they apply, are calculated and shown at checkout.

Prices exclude shipping unless stated otherwise. Shipping is calculated at checkout. We may change prices at any time, but changes will not affect orders we have already accepted. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full.

05Orders and acceptance

When you place an order, you are making an offer to purchase. We will send an order acknowledgement by email, but a binding contract is only formed once we accept your order. This usually happens when we dispatch the goods, or for pre-orders when we confirm the pre-order.

We reserve the right to decline or cancel any order, in whole or in part, at our discretion. This includes where:

• we consider the order high risk, including where we suspect fraud or unauthorised use of a payment method;
• a technical issue with the site, checkout or payment processing has affected the order;
• a price, product description or image was incorrect;
• a discount, promotion or free item was applied in error or used outside its terms;
• an item is out of stock or can no longer be produced;
• we are unable to deliver to the address provided; or
• we reasonably believe these terms have been breached, including orders placed for resale.

If we cancel an order you have paid for, we will refund you in full to your original payment method.

06Pre-orders

Some items are offered on a pre-order basis. For pre-orders:

• Payment is taken at the time you place the order, which reserves your item.
• The estimated dispatch window shown on each product page is a guide only and may change. We will keep you updated if timing shifts materially.
• Images and descriptions of pre-order items are a guide only. The finished pieces may vary slightly in design, colour, trim or finish from what is shown.
• You may cancel a pre-order for a full refund at any time before it is dispatched by contacting us at info@enduroapparel.com.au.
• Where an order contains both pre-order and in-stock items, please see our Shipping & Returns policy for how it will be dispatched.

07Promotions and free items

From time to time we run promotions, such as a free item with orders over a set amount, a free item when you buy a set quantity, or a price for buying pieces together. The details of each current offer are shown on the site and in your cart. Unless stated otherwise:

• Promotions apply only while they are running, while stocks last, and to the products and amounts described.
• Spend thresholds are based on the amount you pay for your items after discounts, excluding shipping. Thresholds for orders in other currencies are shown in your cart.
• Free items are limited to those shown in your cart and are added or removed automatically as your cart changes. They have no cash value and cannot be exchanged for cash or other products.
• Where more than one offer could apply, your cart and checkout show which ones apply together.
• If you return items and your order no longer meets the terms of a promotion, we may ask you to return the free item or deduct its value from your refund.
• We may change, suspend or end any promotion at any time. This will not affect orders we have already accepted.

08Payment

We accept major credit and debit cards (Visa, Mastercard, American Express) and any additional payment options shown at checkout. Payments are processed securely by our third-party payment provider; we do not store your full card details. You confirm that you are authorised to use the payment method you provide.

09Shipping and delivery

Delivery timeframes, costs and coverage are set out in our Shipping & Returns policy. Delivery estimates are indicative and not guaranteed. Risk in the goods passes to you on delivery to the address you provide.

10Returns, exchanges and your consumer rights

Our change-of-mind returns and exchange process is set out in our Shipping & Returns policy. Nothing in these terms limits your rights under the Australian Consumer Law.

11Intellectual property

All content on this site, including the enduro name and logo, the Ø device, product designs, photography, graphics, text and layout, is owned by or licensed to enduro and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any of it for commercial purposes without our prior written permission.

12Your use of the site

You agree to use the site only for lawful purposes. You must not interfere with or disrupt the site, attempt to gain unauthorised access, introduce malicious code, or scrape or harvest content or data. We may suspend or restrict access if we reasonably believe these terms have been breached.

13Third-party links

The site may contain links to third-party websites or services. We provide these for convenience and are not responsible for their content, products or privacy practices. Accessing them is at your own risk.

14Limitation of liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to those rights, and to the extent permitted by law, we are not liable for any indirect, incidental or consequential loss, and our liability for a failure to comply with a consumer guarantee (where it can be limited) is limited, at our option, to replacing the goods or supplying equivalent goods, or paying the cost of doing so.

15Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

16Changes and severability

We may update these terms from time to time. The version published on this page at the time you place an order applies to that order. If any part of these terms is found to be invalid or unenforceable, the remaining parts continue to apply.
